Edirne Administrative Court Canceled the Water Connection Fee in Erikli!

Edirne Administrative Court stated that the municipality can charge a participation fee for this fee, but cannot charge any other fee.

The case was filed by Erikli Environment and Power Union Association. The association had argued that the municipality's water connection fees were exorbitant and unlawful.

The court made the following statements in its decision:

“Works such as providing drinking and potable water services and making water connections are among the primary duties that municipalities have to carry out, regardless of the request of the relevant parties. Since these services are subject to participation fee in accordance with Article 2464 of the Municipal Revenues Law No. 88, it is clear that those who request services in return for these services in accordance with Article 2464 of the Municipal Revenues Law No. 97 cannot be charged a fee according to the tariffs determined by the municipal councils for the services provided.”

The court also stated that the municipality should take into account the money deposited by former subscribers in the past when determining water connection fees.

It is a matter of curiosity what Keşan Municipality will do after the decision. The municipality may appeal the decision or set a new tariff.
