The Court Found Hatay Metropolitan Municipality's Project Justified

The project prepared by Hatay Metropolitan Municipality, which aims to provide comfortable transportation for the citizens of Arsuz with public transportation vehicles that are air-conditioned, have camera and recording systems, are suitable for disabled access, can use Hatay Card with an electronic fare collection system, and will clearly comply with working hours, was implemented with the decision of the UKOME Board.

However, Arsuz transportation cooperatives filed a lawsuit against HBB for various reasons, arguing that the Metropolitan Municipality and UKOME Board did not have the authority to make this decision.

In the statement made by the Metropolitan Municipality, it was stated that the litigation process was completed, and it was stated that the Hatay 2nd Administrative Court made a fundamental evaluation of the project and emphasized that "the authority to make all kinds of regulations regarding public transportation services belongs to the HBB-UKOME Board". withdrew.

In the statement, the court decision noted that the project within the framework of the Master Transportation Plan put into practice by HBB in 2019 was prepared in line with the analysis of passenger counts and other information made by Istanbul Technical University, and concluded that "there is no practice that would disrupt the free competition environment and lead to monopolization..." was recorded.

In summary, in the decision of Hatay 2nd Administrative Court, it was stated that HBB implemented the project with the UKOME Board Decision in order to reduce and systematize the transportation services in the city with quality, human dignity, in accordance with the requirements of the age, without damaging the structure of the city.

The court also noted that "it was understood that the decision in question was an impersonal, concrete, applicable and fit-for-purpose regulation, taking into account the interests of the rights holders" and concluded that there was no unlawfulness in the transaction in question. According to this; The lawsuit filed for the cancellation of the Public Transportation Rehabilitation Project dated April 22, 2021 and numbered 80 was rejected.

In the statement, "The legitimacy of the project prepared by the Hatay Metropolitan Municipality Transportation Department and approved by the UKOME Board was confirmed by the Court Decision. "The project implementation continues, and our citizens living in our Arsuz District will receive the quality transportation services they deserve, with public transportation vehicles operating in accordance with working hours and transportation schedule."
