The Presidential Circular on “Measures for Public Employees in the Disaster Area” was published in the Official Gazette with the signature of President Recep Tayyip Erdoğan.

According to the Presidential Circular published in the Official Gazette, among those working in public institutions and organizations in cities where a state of emergency (OHAL) was declared due to earthquakes in Kahramanmaraş, those who are deemed to be on administrative leave will be deemed to have fulfilled their duties, and their financial, social rights and benefits and other personal rights will be reserved. .

Accordingly, those working in public institutions and organizations in the provinces where a state of emergency (OHAL) was declared due to the earthquakes that occurred on 6 February will be deemed to be on administrative leave, as of the aforementioned date, or the issues regarding the determination of those who will be subject to flexible working methods such as remote working, rotating work, and the situations affected by the disaster. According to the law, it will be evaluated by the provincial governors, provided that the necessary measures are taken and the services are not disrupted.

In this framework, employees who work according to flexible working methods will be considered on administrative leave during the time they are not actually on duty. Those who are deemed to be on administrative leave within the scope of the circular will be deemed to have actually fulfilled their duties based on their employment, and their financial, social rights and benefits and other personal rights will be reserved.
