The “Regulation on Amending the Spatial Plans Construction Regulation” of the Ministry of Environment, Urbanization and Climate Change was published in the Official Gazette and entered into force. In new regulations; While focusing on “energy efficiency” in the city main transportation plans, the way to make Regional Parking Lot in city and neighborhood centers was opened. In the new regulations that increase the role of municipalities in urban aesthetics, legends, which are the sign language of zoning plans, have been made more understandable.

The “Regulation on Amending the Spatial Plans Construction Regulation” of the Ministry of Environment, Urbanization and Climate Change was published in the Official Gazette dated 13 March 2022 and numbered 31777 and entered into force.

Energy efficiency will be given priority in city transport master plans

In order to increase energy efficiency in transportation and make a positive contribution to climate change, a subparagraph (m) was added to the first paragraph of the 7th article of the Spatial Plans Construction Regulation, ensuring that the city transportation master plans give priority to energy efficiency.

In the new regulation (m) it was stated as follows:

“The processes regarding the preparation of the urban transportation master plan are carried out in accordance with the provisions of the 'Regulation on Procedures and Principles for Increasing Energy Efficiency in Transportation' published in the Official Gazette dated 02.05.2019 and numbered 30762.”

City and neighborhood centers were defined, regional parking facilities were provided.

The definitions of city main centers and neighborhood centers, which serve the whole of the settlement and are also defined as "central business areas", have been clarified with the new paragraph added to the 21st article of the same Regulation and made understandable. With the added clause, it was possible to make Regional Parking Lot in city centers and neighborhood centers with plan decisions.

The new paragraph added to the 21st article of the Spatial Plans Construction Regulation is as follows:

“(15) The main centers and sub-centers serving the whole of the settlement are formed by considering their relations and accessibility with each other and taking into account the following issues:

a) Headquarters or central business areas; It includes uses such as management areas, business centers, social infrastructure, accommodation, open and green spaces, general and regional parking lots, transportation main stations. It is essential that these centers are determined at the intersections of collector or secondary roads according to the size of the area they serve, the population, the need for parking and taking into account their accessibility with vehicles, public transportation and bicycle paths.

b) Sub-centres such as district or neighborhood centers; It includes uses such as administrative facility areas, trade, education, health facilities, places of worship, social and cultural facilities, open areas such as parks, playgrounds, squares, general and regional car parks, sports facilities, mainly to serve the population of the district or neighborhood. contains. It is essential to ensure the connection of these centers with each other and with the main center through public transportation, bicycle and pedestrian transportation, open and green space continuity.

Contribution to urban aesthetics

Changes were also made in the first, third, seventh and eighth paragraphs of Article 30 of the Spatial Plans Construction Regulation for urban aesthetics.

The new changes, in which the provisions that will ensure the expansion of urban design studies are created, allow municipalities to establish an "urban design commission" to contribute to urban aesthetics.

The change, which aims to make the urban design widespread by the municipalities, also paves the way for the municipalities to prepare an urban design guide according to the local characteristics of the cities.

In the new regulation; It is emphasized that by making urban design, arrangements can be made to make public areas such as pedestrian zones and squares more aesthetic and human-oriented.

The changes made in the first, third, seventh and eighth paragraphs of Article 30 of the Regulation are as follows:

“(1) The boundaries of the area where the urban design project will be made can be shown in the zoning plan. In case the urban design projects are prepared together with the implementation zoning plans, the necessary details in these projects can be included in the zoning plan decisions.

(3) When necessary, an urban design evaluation commission may be established in the administrations for the purpose of examining and evaluating urban design projects.

(7) The administration may prepare an urban design guide in areas that it deems necessary, aiming at gaining the image, meaning and identity of the space, increasing the aesthetic and artistic value, arranging the buildings in harmony and in a way that creates integrity, and including the decisions as guides and recommendations for implementation within the spatial planning systematic.

(8) Public areas such as pedestrian zones and squares can be arranged with urban design projects in line with the zoning plan decisions.”

Arrangements were also made in the zoning plan demonstrations.

In order to make the zoning plans, which is one of the main duties of the municipalities, easy and understandable, the displays of the zoning plans called "legends" were rearranged in line with the demands and needs of the municipalities.
