The deadline for objections in the title deed process for Yenişehir, which is planned to be built around Kanal Istanbul, has expired. The Ministry of Environment, Urbanization and Climate Change suspended the land registry chart of the first 3 stages of Yenişehir, which is planned to be built around the controversial project Kanal Istanbul, on 17 January 2022 for objections. The one-month appeal process ended on February 15.

TMMOB Chamber of Surveying and Cadastre Engineers Istanbul Branch, one of the objecting institutions, made a statement regarding the latest situation.
“FIELDS WILL TURN INTO LAND AND CONSTRUCTION WILL BE OPENED”
Explaining that the suspended parceling plan and distribution schedules will now be sent to the General Directorate of Land Registry and Cadastre for registration in the statement, "If the application of the 18th article is registered, the fields will turn into land and the obstacle in front of building permit applications will be removed. It is not technically and legally acceptable for this practice, which contains very serious irregularities, to be registered by the General Directorate of Land Registry and Cadastre. Such long-term projects that will deeply affect the residents of the region, Istanbul and our country are not transactions that can be brought into a fait accompli. It has been reported that such applications have not been concluded before 20-30 years in the developed countries of Europe, even in areas of 2-3 decares, which are much smaller than Kanal Istanbul.
“IMPOSSIBLE LOSSES OF RIGHTS ARE IMPOSSIBLE”
In the statement, the warning was made, "If this application is attempted to be registered just to open the area for construction as soon as possible, without any warning, as if by fire in Kanal Istanbul, very serious technical and legal problems and irreparable loss of rights will arise."
“LET THE COMPLAINTS BE CONSIDERED, THE PROCESS STOPPED”
It was noted that the title deed registration, which is planned to be made whether the Kanal Istanbul project is realized or not, means that the concretization of the region will begin, and the following was noted:
*Even if the zoning application will be sent to the General Directorate of Land Registry and Cadastre for registration without taking into account the objections, this application, which contains illegalities and irregularities, should not be registered.
*Because the realization of the registrations will constitute the beginning of an irreversible process. Appeals and litigation processes do not stop the licensing process.
*As soon as the authorized institution gives the building permit, the foundations are laid, the buildings rise, and the fields succumb to the bondage of concrete.
*For this reason, even if the judiciary decides to cancel the application after a while, the actual situation in the field will create situations that are not easy to return. Before the situation in the region reaches this point, the process should be stopped at the very beginning.
*Complaints should be taken into account. The interventions required by the rule of law should be made. The process should be managed properly without creating new legal problems.
*Canal Istanbul zoning practice, which contains many technical and legal mistakes, should be abandoned, title deed registrations should not be allowed before the judicial processes are concluded.
