Upper Floor of Büyükada Pier, Leased to TÜGVA, is Evacuated

The Büyükada pier evacuation process has started. There are no legal obstacles to the evacuation of the upper floor of the Büyükada Pier. The eviction process has started for the implementation of the court decision. With the decision of the Istanbul 2nd Administrative Court dated 28 May 2021, numbered 2021-158, and the Istanbul Regional Administrative Court Tenth Administrative Court's Decisions of objection numbered 2021-765, dated 06.07.2021, the final evacuation of the Büyükada Pier was decided. After the legal process was completed in favor of IMM, the eviction process was started.

The upper part of the Büyükada Pier was leased to the Turkish Youth Foundation (TÜGVA) for 2018 years in 10. İBB wrote a letter to Şehir Hatları A.Ş on February 7, 2020, demanding that the upper floor of Büyükada Pier was transferred to third parties in violation of the usufruct agreement, and the lease agreement was terminated and this area was handed over to İBB.

Since then, the legal process has begun. In summary, the events regarding the upper part of the Büyükada Pier are as follows: Büyükada pier, together with some other piers, was transferred to İBB with the protocol signed between the Turkish Maritime Administration and İBB in 2005, based on the relevant decision of the privatization high board. İBB transferred the Büyükada pier and other similar piers and sea vehicles to Şehir Hatları A.Ş.

City Lines leased the upper part of the pier to the Turkish Youth Foundation (TÜGVA) for 2018 years in 10.

İBB wrote a letter to Şehir Hatları A.Ş on February 7, 2020 and requested that the upper floor of Büyükada Pier was transferred to third parties in violation of the usufruct agreement, and the lease agreement was terminated and this area was handed over to İBB. Thereupon, Şehir Hatları AŞ terminated the lease agreement with TÜGVA on February 3, 21 and requested that this area be evacuated until February 2020, 28. He handed over the area to İBB.

After the area was not evacuated on time, IMM sent a notice to TÜGVA on September 11, 2020 and requested that it be evacuated within 7 days. After the area was not evacuated, this time, IMM, in accordance with the procedure, wrote to the District Governor of Islands on January 6, 2021, requesting the evacuation of the upper part of the Büyükada Pier.

The District Governorate of Islands first gave an evacuation order for January 26, 2021. Later, on the grounds that TÜGVA representatives did not come due to the weather opposition, he postponed the evacuation day to February 2, 2021. Meanwhile, in the lawsuit filed by TÜGVA for the annulment of the eviction, the court decided to stay the execution on January 27, 2021. He stopped the eviction process. However, later, the Istanbul 2nd Administrative Court, with its decision dated 28 May 2021 and numbered 2021-158, rejected the request for the cancellation of the eviction process and the stay of execution. Thus, there was no legal obstacle in front of the eviction process. With this decision, IMM again wrote to the District Governor of Islands on 9 June 2021 and requested that the said place be evacuated and handed over to IMM.

The District Governorship of Adalar wrote to IMM on June 18, 2021, asking for information and documents to be sent that the lease agreement between Şehir Hatları A. A notification was made to Şehir Hatları A.Ş by IMM in order to convey the requested information and documents to the District Governorship of Islands. City Hatları A.Ş sent the requested information and documents to the Islands District Governorate on July 8, 2021.

In the meantime, upon the objection filed by TÜGVA against the decision of the Istanbul 2nd Administrative Court regarding the rejection of the request for stay of execution, with the decision of the Tenth Administrative Case Chamber of the Istanbul Regional Administrative Court, with the objection number 2021-765 and dated 06.07.2021, the objection was definitively rejected. More than 9 days have passed since the letter dated 2021 June 60 written to the Islands District Governorate regarding the evacuation of the upper part of the Büyükada Pier. With the relevant court decisions, there is no legal obstacle to the evacuation of the said area.

IMM will implement the court decisions regarding the evacuation of the upper section of the Büyükada Pier, and will initiate the necessary legal initiatives regarding unilateral, distorted news made in disregard of the law, despite these clear court decisions. Will follow up on this issue.
