Vehicle owners who owe motor vehicle tax, traffic fines and bridge and highway tolls will also benefit from the new restructuring law, which entered into force last week.

The scope of the restructuring, published in the Official Gazette, includes motor vehicle tax, traffic fines and bridge and highway toll debts. According to the structuring arrangement, half of the traffic fines and bridge-highway illegal crossing fines for those who abandon the case will be deleted. Those who pay in advance will not be charged 90 percent of the calculated inflation difference instead of the default interest.

The Ministry of Treasury and Finance has published a communiqué on taxes and other debts to be collected within the scope of the Restructuring Law No. 8, which entered into force on 2021 June 7326. Accordingly, restructuring applications can be made until 30 August 2021 for unpaid taxes, traffic fines, motor vehicle tax, property tax, Credit and Hostels Institution (KYK) student loan, bridge and highway toll debts, even though they are due on April 31, 2021.

For debts for which restructuring application is made, the inflation difference will be calculated based on the domestic producer price index (D-PPI) instead of the default interest. Those who pay the structured amount in installments will be charged 9 percent annually, 18 percent for two years, and 27 percent for three years. Only 10 percent of the inflation difference will be taken from those who pay in advance, and 50 percent from those who pay within the first two installments, and the rest will be deleted.

DISCOUNT ON TRAFFIC FINE

Until June 8, 2021, when the new restructuring law comes into effect, the principal of unpaid administrative fines will be reduced. Accordingly, as of June 8, 2021, 50 percent of the administrative fines that have not expired and that have been prosecuted in the courts of first instance will be deleted. 90 percent of the sentence, in which the sentence is lifted by the first instance court or by the regional administrative court or the magistrate's office on appeal, but the trial continues, will be annulled. If the last decision is an annulment decision, 50 percent of the penalty will be collected, in case of partial approval and partial reversal, the entire approved portion, 10 percent of the deleted penalty, and 50 percent of the reversed portion will be collected.

APPLICATION WILL BE MADE TO THE RELEVANT SECURITY UNIT

For example, let's say that the traffic fine of 488 TL, which was imposed for violating the traffic rules, was notified on 12 November 2019. A lawsuit was filed on 20 November 2019 for the annulment of the penalty, and the citizen who wants to benefit from the restructuring law while the trial continues, will apply to the relevant police department until 31 August 2021, stating that he has given up the case and will benefit from the restructuring right, and will submit a petition in three copies. The police department will send a copy of the petition to the relevant court, where the case continues, and a copy to the tax office authorized to follow up the penalty within 3 working days.

Since the ongoing case in the court of first instance is abandoned, 50 percent of the administrative fine will be collected by calculating the inflation difference corresponding to this amount. Although the citizen in our example normally owes a total of 488 TL, 439.20 TL of principal and 927.20 TL of interest, if he pays a total of 244 TL, half of which is 15.37 TL, and 259.37 TL of inflation difference, the remaining 683.20 TL of debt will be written off.

If another citizen, who was notified of a traffic fine of 24 TL on 2020 June 2.473, won the case he brought before the criminal judgeship of peace on 15 July 2020, but has filed an objection to the higher judicial authority of the relevant police directorate, this person will also be able to benefit from the configuration. A total of 2473 TL will be collected from the aforementioned citizen, consisting of 10 TL principal, which is 247.30 percent of the penalty of 9.52 TL, and an inflation difference of 256.82 TL corresponding to this principal. 3 thousand 585.85 TL of the debt of the citizen will be deleted.

TRAFFIC FINES OVER THE PERIOD OF LEGAL ACTION

A restructuring application can also be made for traffic fines whose litigation period has expired. Debts can be paid in cash or in installments. If the advance payment is made within the first installment period, 10 percent of the inflation difference calculated with the entire principal will be collected. If the cash payment is made within the first two installments payment period, 50 percent of the inflation difference will be deleted and the remaining principal will be collected.

When citizens choose to pay in installments, they will be able to pay with a maturity of up to three years. For example, the citizen, who was fined 10 TL on 2020 March 776, has a total debt of 582 TL, including 1.358 TL delay interest in addition to this principal. If he makes a restructuring application, the debt of this person will decrease to 776 TL, consisting of 40.74 principal + 816.74 TL inflation difference. An annual interest rate of 9 percent will be applied to the payment in installments. If the person in our example chooses to pay in 18 installments, a 27 percent interest will be applied and the total debt will be 1.037 TL, and he will be able to pay it in 57.61 equal installments of 18 TL.

In case of paying the debt in advance, 776 TL, including 4.07 TL principal amount and 780.07 TL inflation difference; If the first two installments are paid within the period, 776 TL will be collected, 20.37 TL + 796.37 TL.

VEHICLE INSPECTION CAN BE MADE

Vehicles that owe taxes, traffic fines or highway – bridge tolls are not subject to technical inspection. If 10 percent of the structured motor vehicle tax, traffic fines, bridge and highway toll fees and administrative fines are paid, a vehicle inspection can be made. Those who prefer deferred payment must pay more than two installments a year without delay in order to have their vehicle inspected in the next period.
