FIRST PART

Purpose, Scope, Basis and Definitions

Goal

ARTICLE 1 - (1) The purpose of this Regulation is; Within the framework of merit and career principles, based on service requirements and planning staff, Turkey Railway Machines Industry Inc. rise sacked contract staff with officials serving in the Headquarters and to determine the procedures and principles for the title change.

ARTICLE 4 - (1) In this Regulation;

SECOND PART

Basis for Promotion and Title Change

Task groups

ARTICLE 5 - (1) The following task groups are as follows:

a) Management services group:

1) Branch manager.

2) Deputy Director.

3) Chief (administrative), fire chief.

b) Legal services group:

1) Legal counsel.

c) Defense services group:

1) Civil defense expert.

d) Technical services group:

1) Chief Engineer.

2) Technical chief.

d) Administrative services group:

1) Train officer, officer, officer.

e) Support services group:

1) Fireman, cook.

(2) The positions subject to the change of title within the scope of this Regulation are as follows:

a) Attorney, engineer, programmer, technician, technician, mechanic.

Conditions to be made in appointments without being subject to promotion examinations

ARTICLE 6 - (1) The following conditions shall be sought for the appointments to be made in the following titles, in addition to the requirement of the service period specified in subparagraph (B) of the article 657 of the Civil Servants Law 68:

a) In order to be assigned to internal auditor staff;

1) To be a graduate of the Faculty or at least four years of college.

2) Having served as a de facto officer at the Head Office for at least five years in civil servant or contracted status,

Certified Internal Auditor (CIA), CISA (Certified Information System Auditor), CCSA (Certified Control Self Assessment), CGAP (Certified Government Auditing Professional), CFSA (Certified Financial Services Auditor) and CRMA (Certification in Risk Management Assurance) to have one,

4) To comply with the requirements of the General Investment and Finance Program of the State Economic Enterprises and its Subsidiaries and other relevant legislation in the current year,

b) In order to be assigned to the legal counsel staff;

1) At least seven years are required to be employed as a lawyer.

General conditions to be searched for the appointments with the exams

ARTICLE 7 - (1) In order to be assigned to the positions / positions subject to the increase within the scope of this Regulation;

a) To have at least one year service within the Head Office,

b) To be successful in the written and oral examination,

(c) To have the period of service in the provisions of Article (B) of Article 657 of the Civil Servants Law No. 68,

ARTICLE 8 - (1) The special conditions to be searched for the appointments to be made by the office are as follows:

a) To be assigned to the branch manager (administrative) staff;

1) To be a graduate of at least four years of college or university,

3) Having served in one of the civil defense expert, chief or consultant titles or having served at least five years in the deputy director / chief (administrative) title, or having served for at least ten years in a civil servant, train building officer, or in one of the positions of the director.

ç) To be appointed as Chief Engineer;

1) Graduate of Faculty of Engineering,

2) At least eight years of service,

3) To have served at least two years in the title of technical chief or at least 4 years in the title of engineer,

conditions are searched.

d) to be appointed as technical chief;

1) To be graduated from one of the vocational or technical departments of at least two year colleges,

2) Two or three-year college graduates for at least eight years, four-year higher education for those who have at least four years of service,

3) One of the technicians, technicians and engineers has at least one 2 year service,

e) to be appointed as the chief (administrative) position;

1) To have at least two years of college degree,

2) Two or three-year college graduates for at least eight years, four-year higher education for those who have at least four years of service,

Conditions for appointment to positions subject to title change

ARTICLE 9 - (1) For positions that can be appointed subject to the title change exam, the title change exam must be successful.

(2) The conditions to be searched by the title change are as follows:

a) to be appointed as a lawyer;

1) Being a graduate of Faculty of Law,

2) To have a legal license,

conditions are searched.

b) To be assigned to the position of an engineer;

1) It is required to be a graduate of Faculty of Engineering.

c) To be assigned to the programmer's position;

1) It is required to graduate from the related departments of higher education schools providing at least two years of computer education.

ç) To be assigned to the technician position;

1) It is required to graduate from related departments of higher education schools providing at least two years of vocational or technical education.

d) to be appointed as a technician;

1) It is required to graduate from the related department of the vocational or technical education and training schools.

e) To be assigned to a mechanist position;

1) Graduates of at least high school and equivalent technical schools or two-year colleges, one of the railroads, railway vehicles, railway construction, machinery, engine, electrical, electronics, automotive departments,

THIRD PART

Procedures and Principles for the Promotion of Title and Title Change Exam

Examination requirement

ARTICLE 10 - (1) Persons to be appointed through the promotion or change of title must be successful in the written and oral examination.

Announcement and application

ARTICLE 11 - (1) The conditions for joining the exam, the procedure in which the examination will be carried out, the number of vacancies / positions and the number of vacancies, the units to be assigned, the exam subjects, the date of the exam and the deadline are announced by the Personnel Department.

(2) As of the last day of the application date; The staff, who have the required conditions for more than one squad and position, can apply for only one of the different positions and positions as stated in the announcement.

(3) The announcement is sent to the units at least thirty days prior to the exam date.

(4) The period between the date of the last application and the date of the examination cannot be less than fifteen days. Examination applications are submitted to the unit where the personnel work, documenting that the application was made within the period. The units submit their applications to the Personnel Department within five working days following the deadline. Examination applications can also be made in electronic form provided that the announcement is stated.

(5) It is also possible for those who are using the permits granted in accordance with the relevant legislation, including those who do not have a monthly track.

(6) Applications made to the Directorate of Personnel Office are examined and those who meet the requirements are announced on the official website of the General Directorate.

(7) Objections to the advertised lists are made to the Personnel Department within five working days from the date of the announcement. Objections are finalized within five working days of the last objection and announced on the official website of the General Directorate.

(8) Personnel of other institutions and organizations, candidate officers and personnel who have been contracted for the first time in the General Directorate and who have signed a contract with them for 6 months, and who are still in this contract can not apply for the promotion or change of title.

Exam Board

ARTICLE 12 - (1) The examination board is formed with the General Manager Olur.

(2) The examination board shall be composed of five members under the chairmanship of the General Manager or the person appointed by him, from the representative or representative of the Personnel Department and from other members.

(3) At least two substitute members may be appointed to the examination board by the same procedure. A substitute member joins the meeting where there is no principal member.

(4) The members of the examination board; they may not be lower in terms of their level of study and their titles, except for postgraduate study.

(5) If the chairman and members of the examination board have been determined to have their spouses to attend the exam or change of title, their spouses to the second degree (including this degree) and their relatives are removed from the examination board and replaced by new members or members.

(6) The examination board convenes with the full number of members and takes decisions with the majority of votes. There can be no abstentions in voting. In case of equality of votes, a majority vote shall be deemed to have been cast. The decision taken as a result of the voting is absolute and the members who do not agree with the decision must state their counter votes together with their reasons.

(7) Secretariat services of the examination board are carried out by the Personnel Department.

The duties and powers of the examination board

ARTICLE 13 - (1) The duties and powers of the examination board are as follows:

a) To take or pass the exams, to take the title change exam.

b) To determine the written exam method and topics, to prepare or prepare the exam questions.

c) To announce the results of the exam.

d) To determine the number of written exam questions and score value according to the weight of the subjects.

d) To finalize the objections.

e) To carry out other tasks related to examinations.

Written examination

ARTICLE 14 - (1) The written exam can be made by the General Directorate, or it can be made to the Head of Measurement, Selection and Placement Center, the Ministry of National Education or a higher education institution.

(2) Written exam subjects are determined by the examination board taking into consideration the qualifications of the announced staff / position and are stated in the announcement.

(3) Written exam is evaluated over a hundred points. Those who have scored at least sixty points in the written exam are considered successful.

Oral examination and oral examination

ARTICLE 15 - (1) The oral examination is announced on the official website of the Directorate General at least fifteen days before the exam date.

(2) Candidates who are assigned the highest score in the written exam from the nominated staff or positions will be given an oral exam until the five-fold number of positions or positions announced. All of the staff with the same score as the last candidate are taken to the oral exam.

(3) Related personnel, by each member of the examination board;

a) The level of knowledge about exam subjects,

b) Comprehending and summarizing a subject, ability to express and reasoning power,

c) The appropriateness of the qualification, representation ability, attitudes and behaviors for the task,

ç) Self-confidence, persuasiveness and credibility,

d) general culture and general ability,

e) Openness to scientific and technological developments,

Based on the face is evaluated over the full score. The verbal score of the staff is determined by taking the arithmetic average of the points given by each member. Those who have scored at least seventy points in the oral exam are considered successful.

Success ranking

ARTICLE 16 - (1) The success score shall be taken as the basis for the assignment of vacancies or positions, which are announced through the promotion or change of title. The achievement score is determined based on the arithmetic average of the written and oral exam scores and announced on the web site of the General Directorate.

(2) In case of equality as a result of scoring, respectively;

a) Those with a longer service life,

b) Those who have completed their higher education,

c) For those with higher education graduation grades,

by giving priority, the success sequence is determined starting from the highest score.

(3) Although they are successful in the job promotion or title change exam, the number of personnel who cannot be appointed due to the announced number of positions or positions can be determined as a substitute in the list of success ranking if required by the General Directorate.

Disclosure of the results of the examination and appeal

ARTICLE 17 - (1) Exam results are announced by the examination board on the website of the General Directorate no later than thirty days after the exams are made and they are deemed to have been notified to the candidates as of the same date. The interested parties may object to the examination results within five working days from the date of announcement. The applications for appeal to the Personnel Department in writing shall be examined by the examination board according to their interest or examined by the examining institution. The results of the examination shall be notified to the concerned parties in writing within ten working days. The decision on the objection is final.

(2) In written exams, the questions which are concluded to be inaccurate by the examination board as a result of the appeal are canceled and accepted as correct by all candidates. However, if the number of incorrect questions is more than ten percent of the total number of questions, the exam is canceled and repeated.

Title change exam

ARTICLE 18 - (1) Appointment of the positions subject to the title change specified in the second paragraph of 5, those who have at least a vocational or technical education at the secondary level; This is done according to the success of the title change exam in the framework of the procedures and principles specified in this Regulation.

(2) Title change written exam, General Directorate to determine the task and the nature of the task to be done on the issues related to the attendance of the General Directorate or those who do not have a duty for a certain period of service in the task is not required.

(3) Only the Headquarters personnel may apply for the tasks under the title change exam.

(4) Those who have completed their doctoral studies within the scope of this Regulation may be assigned to the duties that are subject to education without participation in the title change examination.

(5) If the student has a minimum score of 60 or less than a half of a total in the written exam, a minimum score of 60 is considered successful.

(6) Examinations for the title change examinations and conducts the examination board.

Assignment of those who succeeded by a change in title or title change

ARTICLE 19 - (1) The personnel who are entitled to the appointment shall be appointed according to the success points in the success ranking determined from the highest point following the finalization of the success ranking list.

(2) In case of preference, the personnel shall be appointed according to their preference on the basis of success ranking.

(3) announced positions or positions;

a) the exams are invalid or the appointments are canceled because they do not have the conditions of appointment;

b) the announcement regarding the subsequent examination for the same title or positions not to exceed the six-month period from the date on which the ranking of success is finalized, for reasons of retirement, death, dismissal or expulsion from the civil servant, transfer to another title of staff or positions or other institution; In accordance with Article 16, it can be assigned according to success ranking among the reserves if it is determined by the General Directorate.

(4) Those who have not been appointed for any reason, or who have not been appointed until the announcement of the subsequent examination for the same title, who has not failed for those who did not attend the exam for any reason due to any reason, or have not exceeded the six-month period from the date of the success of the substitution. they are subject to all the procedures and principles set forth in this Regulation for appointments to the same title or positions.

Misrepresentations

ARTICLE 20 - (1) The examination entry document is based on the applicant's application documents filled in the application is understood to be incorrect, the exams are considered invalid, appointments are not made. Approvals of those who have been appointed are canceled.

Retention of test documents

ARTICLE 21 - (1) The documents related to the examination of the exam or title change, the documents related to the examination in the personal files, other documents; If they are not subject to any litigation, the Personnel Department maintains one year according to their interests.

(2) The documents which have been the subject of the case shall be kept for a period of one year and maintained by the Personnel Department for one year after the case is concluded.

CHAPTER FOUR

Miscellaneous and Final Provisions

Transitions between task groups

ARTICLE 22 - (1) The transitions between the duty groups specified in the 399 clause of this Regulation, except for the transfer of those who work in the titles listed in the chart no. 5 to Decree No. XNUMX, shall be made in accordance with the following principles:

a) in the same sub-group; Provided that the request of the relevant staff and the staff or position to be assigned shall be made without any examination, other duties may be assigned to the other positions provided that they have the required training, service period and other conditions.

b) Those who work in the titles listed in the chart no. 399, having the requirement of having a four-year higher education except Civil Defense Professionals; consultant, the chief positions of the examiner without the examinations of the appointment can be made.

c) Transitions between the groups and the transition from sub-group to upper groups are subject to promotion exams. But; Assigned titles at the Head Office or other public institutions and organizations and duties and sub-tasks at the same level as those titles, appointment and other terms as required by the legislation, such as the duration of the service, upon the request of the relevant staff can be appointed without being subject to the examinations.

ç) Assignments to the positions subject to the title change and the transitions between these positions shall be made according to the result of the title change exam to be held for the related title.

Examinations for people with disabilities

ARTICLE 23 - (1) The General Directorate shall take the necessary measures to carry out the examinations of persons with disabilities who have the necessary conditions and who are in a position to perform the assignment.

Assignments from organizations covered by privatization

ARTICLE 24 - (1) The provisions of this Regulation shall not apply in the first appointments made in accordance with the article 24 of the Law on Privatization Applications 11 / 1994 / 4046 dated 21.

Acquired rights

ARTICLE 25 - (1) The rights of the winners and those assigned to these positions are reserved in accordance with the provisions of the relevant legislation.

Circumstances without provision in the regulation

ARTICLE 26 - (1) In cases where there are no provisions in this Regulation, the provisions of the General Civil Code numbered 657 and the General Regulation on the Principles of Promotion and Title Change in Public Institutions and Institutions shall apply.

Level of education

PROVISIONAL ARTICLE 1 - (1) Those who are on the date of 18 / 4 / 1999 with the exception of the chief engineer and who have a two or three year higher education degree as of the same date, are considered to be a four-year higher education graduate in terms of the application of the 8 clause of this Regulation if they have other conditions .

Force

ARTICLE 27 - (1) This Regulation shall enter into force on the date of its publication.

Executive

ARTICLE 28 - (1) The provisions of this Regulation are executed by Turkey Railway Machines Industry Inc. General Manager.
