Regulation on Authorization of Railway Management

Regulation on Authorization for Railway Operations Published: One of the most important regulations regarding the liberalization of railway transportation, ın Regulation on Authorization of Railway Management serbest 19 was published in the Official Gazette dated August 2016 and entered into force.

According to the regulation of the Ministry of Transport, Maritime Affairs and Communications in the current issue of the Official Gazette, real and public legal entities and companies are required to obtain authorization from the ministry for the activities listed.
According to the regulation which determines the types of authorizations and certificates of the railway operators and transporters and of the organizers, to be able to obtain or renew the authorization certificate, the applicants must be a real person, a public legal entity or a company registered in the trade registry registered in accordance with the Law no. it also has to bear the special conditions specified by the regulation.
Under the regulation, freight or passenger train operators shall certify that they have a minimum registered capital of 10 million as of the date of application. The duration of authorization documents was determined as 10.
The Ministry will cancel the certificate of competence of the enterprise if it does not see the financial restructuring of a company that has started bankruptcy or similar transactions.
Railway train operators will give the Ministry an insurance policy in accordance with national and international legislation so that they can meet their financial obligations in the event of an accident. The minimum insurance policy amount cannot be less than 20 million TL per event.
It is also among the requirements that companies that demand to obtain, renew and replace authorization certificates have the necessary knowledge, experience and management organization to perform and monitor the services specified in the authorization document in an effective and safe manner.
By the regulation, TCDD was authorized by the Ministry indefinitely with the DA authorization certificate since it was assigned as the railway infrastructure operator on the part of the national railway infrastructure network which is in the national railway infrastructure network and transferred to the state railway rail infrastructure transferred to it.
With the provisional article added to the Regulation, TCDD Taşımacılık A.Ş. Since it was appointed as a railway train operator with the Law No. 6461, it was authorized by the Ministry for one time with the authorization certificates of DB1 and DB2. However, in order for TCDD Taşımacılık A.Ş. to start its operations, it is required to purchase the insurance policy specified in the regulation.
